1. General and mandatory information

Data protection

Maintaining the confidentiality of the personal data you provide and protecting this data against unauthorised access is our top priority. We therefore exercise the utmost caution and implement the latest security standards to ensure your personal data is given maximum protection.
As a corporation under private law, we are subject to the provisions of the European General Data Protection Regulation (GDPR) and of the German Federal Data Protection Act (Bundesdatenschutzgesetz – BDSG). We have implemented technical and organisational measures that ensure the applicable data protection regulations are observed both by us and by our external service providers.

When you use this website, various pieces of personal data are collected. Personal data is data that can be used to personally identify you (e.g. name, address or email address) and data on user behaviour. When you contact us via email or using a contact form, we store the data that you share with us (your email address, and your name and telephone number where applicable) to enable us to respond to your enquiry. We delete data that we receive in this context once it no longer needs to be stored, or we restrict the processing of this data if statutory retention obligations apply. This Privacy Policy explains which data we collect and what we use it for. It also explains how this happens and for what purpose.

If, for certain functions that we offer, we use commissioned service providers or wish to use your data for advertising purposes, we explain the relevant processes in detail below. We also set out the defined criteria for the storage duration.

Please note that transferring data online (e.g. when communicating via email) can pose security risks. It is not possible to completely protect data against third-party access.

SSL and TLS encryption

This site uses SSL and/or TLS encryption for security reasons and to protect the transmission of confidential information, e.g. enquiries that you send us as the site operator. 2. Your rights

Your rights as a data subject are derived in particular from Art. 15 et seq. GDPR:

  • Fundamentally, you are entitled to request information regarding whether we process personal data relating to you. If we do, you also have the right to information about this personal data and to other information related to the processing (Art. 15 GDPR). If personal data relating to you is not or is no longer accurate or is incomplete, you may request the rectification and, where applicable, completion of this data (Art. 16 GDPR)
  • Where the statutory conditions are met, you may request the erasure of your personal data (Art. 17 GDPR) or the restriction of the processing of this data (Art. 18 GDPR).
  • You have the right to have provided to you or a third party the data that we process by automated means on the basis of your consent or for the purposes of performing a contract in a commonly used and machine-readable format (Art. 20 GDPR). If you request the direct transfer of the data to another controller, this will be carried out only to the extent that this is technically feasible.
  • If data processing is carried out on the basis of Art. 6(1)(e) or (f) GDPR, you have the right at any time, on grounds relating to your particular situation, to object to the processing of your personal data; this also applies to any profiling based on these provisions. The relevant legal basis on which a processing operation is based is explained in this Privacy Policy. If you object to the data processing, we will no longer process your personal data concerned unless we can demonstrate compelling legitimate grounds for the processing that override your interests, rights and freedoms or the processing is carried out for the establishment, exercise or defence of legal claims (objection in accordance with Art. 21(1) GDPR).
  • If your personal data is processed for direct marketing purposes, you have the right to object to the processing of personal data relating to you for such marketing at any time; this also applies to profiling to the extent that it is related to such direct marketing. If you object, your personal data will then no longer be used for direct marketing purposes (objection in accordance with Art. 21(2) GDPR).

 

In accordance with Art. 77 GDPR, you also have the right to lodge a complaint with a data protection supervisory authority. To do this, you may contact the relevant supervisory authority for your habitual residence or for our address.

 

Withdrawing your consent to data processing

Many data processing operations can only be carried out with your express consent. You may withdraw consent that you have previously given at any time. To do this, it is sufficient to send us an email or letter; this can take any form. The lawfulness of the data processing carried out before consent is withdrawn is not affected by this withdrawal of consent.

Where we base the processing of your personal data on a weighing of interests, you may object to this processing. This is the case in particular if the processing is not required to perform a contract with you, as explained in the description of functions below. If raising such an objection, we ask that you please provide the reasons why we should not process your personal data as we have been. In the event of a justified objection, we will review the matter and either stop or modify the data processing or inform you of our compelling legitimate grounds for continuing the processing.

 

 

3. Data collection when visiting our website

Server log files

If using the website purely for informational purposes, i.e. if you do not provide any information to us, we collect only the personal data that your browser transmits to our server automatically. If you wish to view our website, we collect the following data, which we require for technical reasons in order to display our website to you and to ensure stability and security (legal basis is Art. 6(1)(1)(f) GDPR):

  • IP address of the requesting computer
  • Date and time of access
  • Time zone difference to Greenwich Mean Time (GMT)
  • Name and URL of file and data volume retrieved
  • Access status/HTTP status code
  • Website from which our site is accessed (referrer URL)
  • Browser used, language and version of browser software
  • Operating system of your computer and name of access provider.

 

Cookies

In addition to the data specified above, cookies are stored on your computer when you use our website. Cookies are used to make our website more user-friendly, efficient and secure. Cookies are small text files that are assigned to the browser you use and stored on your hard drive. They enable certain information to be supplied to the party that has set the cookie (in this case, us). Cookies cannot execute any programs or transfer any viruses to your computer.

Most of the cookies that we use are called “session cookies.” These are automatically deleted at the end of your visit. Other cookies remain stored on your end device until you delete them. These cookies allow us to recognise your browser the next time that you visit our website.

You can configure your browser so that you are notified when cookies are set and to only allow cookies in individual cases, to exclude the acceptance of cookies in certain cases or in general or so that cookies are deleted automatically when you close the browser. The website operator has a legitimate interest in storing cookies to ensure the technically fault-free and optimised provision of its services. jQuery

Content from third-party providers is also used. This may include videos, fonts and scripts. To display the content provided by third parties, it is necessary to send your IP address to the relevant provider for technical reasons. We do not have any influence over how the relevant third-party provider uses your personal data. Google reCAPTCHA

In connection with the newsletter subscription option, we also use the Google service reCAPTCHA to determine whether it is a human or a computer entering information in our contact or newsletter form. Google checks whether you are a human or a computer based on the following data: The IP address of the end device used, the webpage of ours that you are visiting and on which the CAPTCHA is integrated, the date and duration of the visit, the identification data for the type of browser and operating system used, your Google account if you are logged into Google, mouse movements on the reCAPTCHA areas and the tasks where you have to identify images. The legal basis for this data processing is Art. 6(1)(f) GDPR. We have a legitimate interest in this data processing to ensure the security of our website and to protect ourselves against automated entries (attacks).

 

 

4. Other functions and offers on our website

In addition to the use of our website for informational purposes only, we offer various services that you can use if interested. To do so, you generally need to provide further personal information, which we will use to provide the relevant service and to which the aforementioned data protection principles apply.

In some cases, we use external service providers to process your data. These service providers have been selected and commissioned with care, are bound by our instructions and are monitored regularly.

In addition, we may pass on your personal data to third parties if promotions, contracts or similar services (e.g. newsletter subscription) are offered by us in cooperation with partners. Further information on this subject will be provided when you enter your personal data or in the description of the offer.

If our service providers or partners are based in a country outside of the European Economic Area (EEA), we will inform you about the consequences of this in the description of the offer.

 

 

5. Newsletter

With your consent, you can subscribe to our newsletter, which we use to send you information about changes to the business, messages about our relationship, personal invitations to events, information about product, design and industry trends, and special sales offers and promotions.

We use the double opt-in procedure for subscription to our newsletter. This means that after you have subscribed, we will send an email to the specified email address in which we ask you to confirm that you wish to receive the newsletter. If you do not confirm your subscription within 24 hours, your information will be blocked and will be deleted automatically after one month. Furthermore, we store the IP addresses that you use and the dates and times of subscription and confirmation. The purpose of this method is to verify your subscription and to identify any potential misuse of your personal data.

The only mandatory piece of information that you need to provide to receive the newsletter is your email address. The provision of any other data marked separately is voluntary and is used to enable us to address you personally. Once we have received your confirmation, we will store your email address for the purposes of sending the newsletter. The legal basis for this is Art. 6(1)(1)(a) GDPR.

You may withdraw your consent to the sending of the newsletter at any time and unsubscribe from the newsletter. You can withdraw your consent by clicking on the link provided in each newsletter email, by emailing info(at)d-beschlag.de or by contacting us using the contact details provided in the legal information.

To send the newsletter, we use your personal data in order to analyse your user behaviour. To this end, your personal data is sent to the service provider CleverReach GmbH & Co. KH to personalise the newsletter. Within the scope of commissioned data processing, the service provider is obligated to observe data protection.

 

 

6. Applications

We provide the opportunity for you to apply to us (e.g. by email or by post). In this section, we provide information about the scope, purpose and use of your personal data that is collected during the application process. We process your data in accordance with the EU General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG). In accordance with Art. 12, 13 and 21 GDPR, we provide you with information about the processing of your data in the following.

We process your data that you have provided to us as part of an application for a vacancy or as part of a speculative application in accordance with Art. 6(1)(b) GDPR and Section 26(1) BDSG in order to assess the possibility of employing you. We also process your personal data where we have a legitimate interest in storing it in accordance with Art. 6(1)(f) GDPR, e.g. to defend against claims (e.g. under the German General Act on Equal Treatment [Allgemeines Gleichbehandlungsgesetz]). This includes all personal data normally collected by us and all personal data provided by you during the application process. This may be general information about you (name, address, contact details), information about your professional qualifications and academic education, and information about continuing professional development, as well as any other information that you share with us in the context of your application. This includes documents and the information contained in these documents (cover letter, CV, certificates and other documents sent to us) and any photo submitted.

We do not use your data in any way for automated decision-making or profiling.

You submit your application to us voluntarily. There is no legal or contractual obligation at the time of the application. If you do not submit your application documents, you will not be able to participate in our applicant selection procedure. Accordingly, without your application documents, we will not be able to offer you an employment contract.

The data that you provide is made accessible to the persons responsible in the HR department and those making the relevant decision in the company during the application process. The transfer of this data to third parties is excluded.

We process your application data only within Germany or within the EU and have no intention of processing the data in a third country.


Storage and erasure of data

The data that you provide will be erased no later than six month after a decision has been made regarding your application unless a longer retention period is required on account of legal disputes. If your application leads to a contract being concluded, your data will be stored and processed as part of the standard hiring process in accordance with the relevant legal regulations.

We may not initially be able to offer you a job, but may still wish to stay in contact with you. If this is the case, we will store your application only if you have consented to this in advance (Art. 6(1)(a) GDPR). We will store data that we process on the basis of your consent until this consent is withdrawn, however not for longer than two years.

 

Your rights

As a data subject whose data we process, you have the following rights in accordance with Art. 15 et seq. GDPR under the conditions defined therein:

In accordance with Art. 15 GDPR, you have the right at any time to obtain information about your data that we have stored, the purpose of storage, the category of personal data, the categories of recipients and the planned storage duration. In addition, in accordance with Art. 16 GDPR, you have the right to request the rectification of inaccurate data and the completion of incomplete data. Under the conditions of Art. 17 GDPR, you have the right to request the erasure and/or under the conditions of Art. 18 GDPR, you have the right to request the restriction of the processing of your personal data that we have stored, unless the processing is required to exercise the right to freedom of expression and information, to fulfil a legal obligation, in the public interest or to establish, exercise or defend legal claims. Furthermore, you have the right to request a data transfer at any time under the conditions defined in Art. 20 GDPR. 

You also have the right to lodge a complaint with a data protection supervisory authority in accordance with Art. 77 GDPR.

If the processing is based on Art. 6(1)(a) GDPR or Art. 9(2)(a) GDPR (consent), you in addition have the right to withdraw consent at any time without this affecting the lawfulness of the processing carried out based on your consent before it was withdrawn.

You are entitled to object to the storage and use of your data at any time in accordance with Art. 21 GDPR if the processing is carried out on the basis of legitimate interests in accordance with Art. 6(1)(1)(f) GDPR and there are grounds for this relating to your particular situation.
